DeadAccount.ai Terms of Service

DeadAccount.ai is a product of Mangosteen Studio LLC ("Mangosteen Studio," "we," "us," or "our"). By accessing or using DeadAccount.ai, you agree to be bound by these Terms of Service. If you are using the service on behalf of a company or organization, you represent that you have the authority to bind that entity to these terms.
1. The Service
DeadAccount.ai provides AI-powered account intelligence, including dead account detection, account tiering (T1 / T2 / T3), and CRM data enrichment. Features may vary by plan and are subject to change. We reserve the right to modify, suspend, or discontinue any part of the service. For non-emergency changes, we will provide at least 14 days' written notice. In the event of a security incident, legal obligation, or critical infrastructure issue, we may act without prior notice and will notify you as soon as reasonably practicable thereafter.
Important notice regarding AI outputs: AI-generated outputs produced by DeadAccount.ai, including account status classifications and CRM enrichment data, are probabilistic in nature and should be treated as decision-support tools only. They must be reviewed by a human before being used in critical business decisions. We make no guarantee of accuracy or completeness.
2. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at help@mangosteen.studio if you suspect unauthorized access.
3. Your Data
You retain ownership of all data you upload or sync to DeadAccount.ai. By uploading data, you grant Mangosteen Studio LLC a limited license to process that data solely to provide the service. You are responsible for ensuring you have the right to upload and process any data you submit. Do not upload data that you do not have permission to use.
Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the service, you acknowledge that you have read and understood the Privacy Policy. If you are located in the European Economic Area, United Kingdom, or California, additional rights and obligations apply as described in Section 13 (Privacy and Data Protection).
4. Acceptable Use
You agree not to:
- Use the service for any unlawful purpose or in violation of any applicable regulations
- Attempt to reverse-engineer, scrape, or extract the underlying models or data pipelines
- Resell or sublicense access to the service without written permission from Mangosteen Studio LLC. For clarity, agency use — where a consultant or agency purchases a Team plan and uses it on behalf of client accounts — is permitted provided the agency is the contracting party and is responsible for compliance with these Terms
- Upload personally identifiable information beyond what is necessary to provide the service
- Interfere with or disrupt the integrity or performance of the service
Consequences of violation: Violation of any provision of this section may result in immediate suspension or permanent termination of your account, with or without notice depending on the severity of the violation. We reserve the right to report unlawful conduct to appropriate authorities.
5. Billing and Cancellation
Subscription Plans
Paid plans are billed monthly or annually as selected at checkout. All payments are processed securely through Stripe. Prices are listed in US dollars and are subject to change with 30 days' notice.
Plan Changes and Upgrades
Upgrades: When you upgrade to a higher plan (including multi-tier jumps, e.g. Starter directly to Team Annual), the upgrade takes effect immediately. We will prorate any unused days on your current plan as a credit toward the new plan's charge.
Downgrades: When you downgrade to a lower plan, the downgrade takes effect at the end of your current billing period. You retain access to your current plan's features until that date. No prorated refund is issued for the remaining period on a higher plan.
Annual to Monthly switch: If you switch from an annual plan to a monthly plan mid-cycle, we will apply the unused portion of your annual payment as a credit toward future monthly invoices via Stripe Customer Balance. Credits will be applied automatically until exhausted.
Cancellation and Resubscription
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period and your access continues until that date.
If you cancel your subscription and later wish to resubscribe, you may do so at any time through the standard checkout flow. Resubscription initiates a new subscription with a new billing cycle from the date of resubscription. Prior billing history is not carried over.
Scan Allotments
Each plan includes a monthly allotment of account scans. A scan is considered "consumed" when an account is successfully submitted for processing, regardless of the result returned. If a scan fails due to a verified system error on our side, we will restore the consumed scan at our discretion. Unused monthly allotment scans do not roll over and expire at the end of each billing period.
Purchased Scan Credits
Purchased scan credits (top-up credits purchased outside of a plan allotment) do not expire and remain available on your account regardless of plan changes or downgrades. Credits are consumed before monthly allotment scans. Purchased credits are non-refundable once applied.
Payment Failure
If a scheduled payment fails, your account will remain active for up to 7 days while we attempt to process the charge. Stripe will retry the charge automatically on a smart schedule during this window. During this period you will receive notice to update your payment method. If payment is not resolved within 7 days, your account will be placed in read-only mode — you may view past scan results but will not be able to run new scans — until a successful payment is received. Sections 9 (Disclaimer of Warranties) and 10 (Limitation of Liability) apply during any payment failure period.
Refund Policy
For monthly plans, you may request a full refund within 7 days of the initial charge for that billing period. For annual plans, you may request a prorated refund within 30 days of the annual charge — you will be charged for the time the service was used and refunded the remainder. Refund requests submitted outside these windows will not be honored. Approved refunds will be processed to the original payment method within 5–10 business days. To request a refund, contact help@mangosteen.studio with your account email and reason for the request.
6. Team Plans
This section applies to accounts subscribed to a Team plan.
Billing owner: The individual who subscribes to a Team plan is the billing owner and is responsible for all charges associated with the account, including charges for invited members.
Member access: The billing owner may invite users up to the seat limit of their plan. Invited members access the service under the billing owner's subscription. Mangosteen Studio is not responsible for access disputes between a billing owner and their invited members.
Cancellation effect: If the billing owner cancels the Team plan subscription, all invited team members will lose access at the end of the current billing period. Before cancellation is confirmed, the billing owner will be shown a notice identifying the number of team members whose access will be affected. Billing ownership transfer is not available in the current version of the product. Mangosteen Studio LLC is not liable for loss of access resulting from the billing owner's cancellation decision.
7. Account Termination
Termination by you: You may terminate your account at any time by cancelling your subscription and contacting help@mangosteen.studio to request account deletion. Upon confirmed deletion, your data will be handled in accordance with Section 8 (Data Retention and Deletion).
Termination by us: We reserve the right to suspend or permanently terminate your account, with or without prior notice, if we determine in our sole discretion that you have violated these Terms, engaged in fraudulent activity, or if continued access poses a risk to the service or other users. For non-urgent violations, we will provide written notice and a reasonable opportunity to cure before termination. For serious violations (including but not limited to unauthorized resale, data abuse, or disruption of service), termination may be immediate.
Effect of termination: Upon termination, your right to access the service ceases immediately. Purchased scan credits are non-refundable upon termination for cause. Termination does not relieve you of any payment obligations incurred prior to termination.
8. Data Retention and Deletion
We retain your account data for as long as your subscription is active and for up to 90 days following account cancellation or termination. This retention period allows you to reactivate your account and recover scan history if needed.
After the 90-day retention period, your data will be permanently deleted from our systems, except where we are required to retain certain records for legal, tax, or compliance purposes (such as payment records, which may be retained for up to 7 years in accordance with applicable law).
Data deletion requests: You may request early deletion of your data at any time by contacting help@mangosteen.studio. We will confirm and action deletion requests within 30 days. Note that early deletion is permanent and irreversible; we cannot restore deleted data.
We do not sell your data to third parties. Data is processed only to deliver the service as described in these Terms and our Privacy Policy.
9. Disclaimer of Warranties
The service is provided "as is" and "as available" without warranties of any kind, express or implied. Mangosteen Studio LLC does not warrant that the service will be uninterrupted, error-free, or that results produced by the service (including account status classifications) will be accurate or complete. AI-generated outputs should be reviewed by a human before being used in critical business decisions.
10. Limitation of Liability
To the fullest extent permitted by law, Mangosteen Studio LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service. Our total liability to you for any claim shall not exceed the amount you paid to us in the twelve months preceding the claim.
11. Intellectual Property
DeadAccount.ai, the DeadAccount.ai name and logo, and all associated product features and content are owned by Mangosteen Studio LLC. Nothing in these terms grants you any right to use our trademarks, logos, or brand elements without prior written consent.
12. Dispute Resolution
Informal resolution: Before initiating any formal proceeding, both parties agree to first attempt to resolve any dispute informally. The party raising a dispute must provide written notice to the other describing the issue in reasonable detail. Both parties will attempt in good faith to resolve the matter within 30 days of such notice.
Binding arbitration: If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will be conducted in the state identified in Section 14. The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class action waiver: You agree that any claims must be brought in your individual capacity and not as a plaintiff or class member in any purported class action, collective action, or representative proceeding.
Small claims exception: Either party may bring an individual claim in small claims court if the claim qualifies, as an alternative to arbitration.
Exception for injunctive relief: Nothing in this section prevents either party from seeking emergency injunctive or other equitable relief from a court to prevent irreparable harm pending arbitration.
13. Privacy and Data Protection
Your use of DeadAccount.ai is subject to our Privacy Policy, which governs how we collect, use, and protect personal data. By using the service, you consent to the data practices described therein.
GDPR (European Users): If you are located in the European Economic Area or United Kingdom, you have rights under the General Data Protection Regulation (GDPR) including the right to access, rectify, port, and erase your personal data. To exercise these rights, contact help@mangosteen.studio. We will respond within 30 days.
CCPA (California Users): If you are a California resident, you have rights under the California Consumer Privacy Act (CCPA) including the right to know what personal information we collect, the right to delete it, and the right to opt out of its sale. We do not sell personal information. To exercise your rights, contact help@mangosteen.studio.
For B2B customers uploading data that includes contact-level information, you are acting as the data controller for that information and are responsible for ensuring your use of the service complies with applicable data protection law.
14. Governing Law
These terms are governed by the laws of the State of Delaware, without regard to conflict of law provisions. Subject to the arbitration agreement in Section 12, any disputes not resolved through arbitration shall be resolved in the state or federal courts located in Delaware, and both parties consent to the personal jurisdiction of those courts.
15. Force Majeure
Mangosteen Studio LLC shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, labor disputes, government actions, internet or infrastructure outages, or failures of third-party service providers (including cloud hosting providers, payment processors, or AI API providers). We will use commercially reasonable efforts to resume service as quickly as practicable.
16. Changes to These Terms
We may update these Terms of Service from time to time. We will notify you of material changes by email or by posting a notice on the site at least 14 days before they take effect. Continued use of the service after changes constitutes acceptance of the updated terms. A changelog of material revisions will be maintained and made available upon request.
